1. Who We Are and What This Covers
NearbyLocalDeals ("NearbyLocalDeals", "we", "us") operates the website at nearbylocaldeals.com and its related services — a local business directory where people in India discover nearby businesses, offers and jobs, and where business owners list and promote themselves.
This policy explains what personal data we collect, why, who we share it with, how long we keep it, and the rights you have. It applies to everyone who uses the platform: visitors, registered users, business owners ("vendors"), job seekers and recruiters.
We act as a Data Fiduciary under India's Digital Personal Data Protection Act, 2023 ("DPDP Act") and as an intermediary under the Information Technology Act, 2000. By using the platform you consent to the practices described here.
2. Information We Collect
Information you give us
- Account details — name, email address, mobile number, city and password (stored only as a one-way hash, never in readable form).
- Business listing details — business name, category, address, phone, WhatsApp number, email, website, GST number, photos, videos, working hours and any other content you publish on your listing.
- Enquiry details — your name, phone number, email and what you are looking for, when you submit an enquiry to a business.
- Job application details — your name, contact details and any résumé or document you upload when applying to a job posted on the platform.
- Reviews and other content — ratings, review text and images you post.
- Support and billing correspondence — messages you send us, and records of plan purchases and invoices.
Information we collect automatically
- Location. If you allow the browser location permission, we collect your device's precise coordinates to sort results by distance and show "near me" results. This is optional — you can decline, and you can revoke it at any time in your browser settings. If you decline, we fall back to the city you select. We may also derive an approximate city from your IP address; we never treat that approximate position as a precise location.
- Device and usage data — IP address, browser and device type, pages viewed, referring page, and the actions you take (searches, listing views, taps on Call / WhatsApp / Directions).
- Local storage. We store your chosen location, recent searches, saved businesses and your login session in your browser's local storage so the site works between visits. Clearing your browser storage removes them.
3. How We Use Your Information
- To operate the platform: show listings, offers and jobs relevant to your location and search.
- To create and secure your account and keep you signed in.
- To deliver your enquiry to the business you chose to contact (see section 4).
- To let recruiters receive and review job applications you submit.
- To publish the listing, offers, jobs and reviews you choose to post.
- To give business owners performance statistics for their own listing — views, calls, WhatsApp taps, direction requests and enquiries.
- To review, verify and moderate listings, offers, job posts and reviews before or after they go live.
- To process plan purchases, issue invoices and send billing and expiry reminders.
- To send service notifications (approval, rejection, expiry, replies to your enquiries).
- To detect, prevent and investigate fraud, spam, scraping and abuse.
- To comply with legal obligations and respond to lawful requests.
4. When You Contact a Business, Your Details Go to That Business
This is the core of how the platform works, so we want it to be unmistakable. When you submit an enquiry form, or tap Call, WhatsApp, Directions or Visit Website on a listing, we create a lead and share it with that business. The lead includes the details you entered — typically your name, phone number, email and what you are looking for — together with the date and time.
The business is a separate, independent party. Once your details reach them, they decide how they contact and store you, and their own practices apply. We do not control that, and we are not responsible for it. If you do not want a business to have your contact details, do not submit an enquiry or use the contact buttons on their listing.
The same applies to job applications: your application and any résumé you upload are shared with the recruiter who posted that job.
5. Who Else We Share Data With
We do not sell your personal data, and we do not share it for third-party advertising. We share it only with:
- Businesses you chose to contact — as described in section 4.
- Service providers who run our infrastructure — cloud hosting and databases, file and image storage and delivery, and the email service that sends your one-time codes and notifications. They process data on our instructions only.
- Payment providers, when a paid plan is purchased. Card and banking details are handled by the payment provider — we do not receive or store them.
- Maps — the map shown on a business page is embedded from a third-party maps provider, which may receive your IP address and standard request data when the map loads.
- Authorities, when we are legally required to disclose, or where disclosure is necessary to protect our rights, our users' safety, or to investigate fraud or abuse.
- A successor, if our business is merged, acquired or reorganised; this policy would continue to apply to the data transferred.
6. How Long We Keep Data
- Account and listing data — while your account or listing is active, and for a reasonable period afterwards so it can be restored if the deletion was a mistake.
- Leads and enquiries — kept in the business owner's dashboard so they can follow up, and in our records for fraud prevention and dispute resolution.
- Billing records and invoices — retained for as long as tax and accounting law requires.
- Logs and usage data — retained for a limited period for security and troubleshooting.
When data is no longer needed for the purpose it was collected for, or a legal obligation to keep it, we delete or anonymise it.
7. Your Rights
Subject to the DPDP Act and other applicable law, you may:
- Access a summary of the personal data we hold about you and how it is processed.
- Correct or complete inaccurate or incomplete data. Most details can be edited directly in your profile or business dashboard.
- Erase your personal data where we no longer need it. Account deletion can be requested from your account settings.
- Withdraw consent at any time — including revoking location permission in your browser, or opting out of notification categories in your dashboard. Withdrawing consent does not undo processing already carried out.
- Nominate another person to exercise your rights in the event of death or incapacity.
- Raise a grievance with our Grievance Officer (section 11), and escalate to the Data Protection Board of India if you are not satisfied.
Some data cannot be erased on request — for example invoices we must retain by law, and leads already delivered to a business, which are that business's own records. To ask a business to delete what it holds, you will need to contact it directly.
8. Security
We protect your data with measures appropriate to the risk: passwords are stored only as one-way hashes, sign-in uses one-time codes sent to your email, administrator sessions are short-lived and can be revoked, and access to production data is restricted. Traffic between your browser and our servers is encrypted in transit.
No system is completely secure. Keep your password confidential and do not share your one-time codes with anyone — we will never ask you for them. If we become aware of a personal data breach affecting you, we will notify you and the Data Protection Board as required by law.
9. Children
The platform is not intended for children under 18, and we do not knowingly collect their personal data. If you believe a child has provided us personal data, contact our Grievance Officer and we will delete it.
10. Changes to This Policy
We may update this policy as the platform changes or the law does. The "Last Updated" date at the top always reflects the current version, and we will give prominent notice on the site before a material change takes effect. Continuing to use the platform after a change means you accept the updated policy.
